Terms of Service

Last updated October 21, 2026.

These Terms of Service govern access to consentverified.com and use of ConsentVerified. The service is provided by the administrator of the consentverified.com service, referred to as we, us, or our. By accepting these terms or using the service where acceptance is required, you agree to them on behalf of yourself or the business you are authorized to represent. Contact [email protected] with questions.

Your agreement and authority to use the service

ConsentVerified is a business compliance tool. You must have legal capacity to enter this agreement and authority to act for any organization whose account or data you manage. You are responsible for making sure authorized users understand and follow these terms. Do not use the service if you cannot meet those requirements.

Your subscription selection, applicable order terms, and any data processing agreement form part of the agreement. A separately accepted written agreement controls where it expressly changes these terms. The data processing agreement controls conflicts about processing customer personal data. Mandatory law applies regardless of a contractual term that attempts to exclude it.

What the service does

ConsentVerified provides disclosure language checks, consent capture, certificates, lead verification, messaging consent records, list checks, and evidence storage and export, according to the features and allowances in your subscription. The Consent Language Checker is also offered as a free one-off tool. Using that checker does not create a paid subscription unless you separately select and purchase one.

Certificates record captured information about a submission event. Verification results and disclosure scores support your review of that evidence. They are not a guarantee of consumer identity, lawful consent, successful message delivery, or compliance with every rule that may apply. Features that depend on your form, integration, or instructions require you to configure and test them appropriately.

Keep account access and integrations secure

Provide accurate account information and keep it current. Protect passwords, authentication codes, API keys, and other credentials, and restrict access to authorized users. You are responsible for the activity of people you authorize and for configuring roles, integrations, and contact routing under your control.

Notify us promptly if you suspect unauthorized access or a security issue. Do not share credentials through support email or expose them in public code or pages. We may require reasonable verification before changing account access or acting on an account request. Team features and access controls depend on the selected plan.

Subscription billing and automatic renewal

Subscriptions are billed monthly or yearly according to the option selected at purchase. A yearly price expressed per month is billed for the full yearly subscription period, not as a monthly installment. The price, billing period, and applicable taxes or charges are presented before you confirm the purchase. You authorize recurring charges through your selected payment method.

Your subscription renews automatically for the same billing period until you cancel. Cancel before the next renewal to prevent the next subscription charge. You can cancel through the account's subscription controls or contact [email protected] for assistance. Contact support before renewal if you need help completing a cancellation.

After cancellation, access continues until the end of the paid period unless access is suspended or terminated for a reason permitted by these terms or applicable law. Cancellation prevents future renewal and does not automatically delete customer records. Retention and export remain subject to the applicable plan, data processing agreement, and lawful preservation requirements.

Refund rights are governed by applicable law and any express terms presented at purchase or agreed in writing. If you believe a charge is incorrect, contact support with the relevant account and invoice reference so we can investigate. Do not send payment card details by email.

Monthly limits and subscription changes

Plan limits reset monthly, including when a subscription is billed yearly. A yearly payment does not make the entire year's monthly allowances available at once. Your selected plan determines the included certificates, verifications, disclosure checks, list checks, retention, and team features. Review the pricing page and your order terms before selecting a subscription.

You may upgrade to a plan that meets higher usage or feature requirements. The price adjustment, effective date, and any prorated charge are disclosed before you confirm the change. Do not assume that an upgrade changes historical retention obligations or restores records already deleted under the applicable terms. Confirm your requirements before making a change.

Enterprise subscriptions include the allowances listed on the pricing page, with invoicing available. We do not charge for an additional paid service without authorization under the terms you accept. If usage reaches a plan limit, review the account's options or contact support rather than attempting to bypass the limit.

Your responsibility for consent and lawful contact

You are responsible for the lawful collection, use, disclosure, and retention of your data and for every call, text, or other contact you make or authorize. Provide required notices, obtain and maintain legally sufficient permissions, and ensure that the intended seller, purpose, and channel are supported by the relevant evidence. A subscription does not transfer those duties to us.

Apply suppression, revocation, do-not-call, calling time, messaging, consumer protection, and industry-specific requirements that apply to your activities. Verify source eligibility and permitted use when buying leads. Follow any applicable carrier or campaign rules. A certificate or successful software check does not override a later withdrawal, a contact restriction, or a separate legal obligation.

Test capture and verification on the forms and integrations you use. Keep disclosures accurate and visible, preserve the link between a lead and its evidence, and review how failures affect routing. If you use records from another provider, you remain responsible for that provider's access requirements, retention arrangements, and any buyer agreement that requires its evidence.

ConsentVerified is a compliance tool, not a law firm, and does not provide legal advice. Product text, checker suggestions, scores, and support responses do not create an attorney-client relationship. Consult qualified counsel for the requirements that apply to your business and the legal sufficiency of a particular disclosure or contact.

Use the service lawfully and preserve evidence integrity

Use the service only for lawful purposes within your authority and subscription. Do not use it to harass people, support unlawful communications, collect data without the required rights, or evade restrictions on consumer contact. Do not submit malicious code or use the service in a way that interferes with its security or operation.

  • Do not fabricate consent, alter evidence to misrepresent an event, or attach a certificate to an unrelated lead.
  • Do not access another customer's records or attempt to bypass access controls, rate limits, or subscription limits.
  • Do not scrape or redistribute protected service content or exploit the service to build an unauthorized competing offering.
  • Do not upload unnecessary sensitive information or data you lack authority to process.
  • Do not misrepresent a software result as legal approval or a guarantee from ConsentVerified.

Report suspected security issues privately to [email protected]. Investigating an issue does not authorize accessing other people's data or disrupting the service.

Your data ownership and processing instructions

You retain ownership and control of customer data you submit, capture, or store through the service. You give us the limited rights needed to process that data to provide the service, follow your authorized instructions, maintain security, and comply with applicable law. Those rights do not transfer ownership of your leads or consent records to us.

For consumer lead data processed on your behalf, you act as controller or business and we act as processor or service provider, as applicable. Processing is subject to the applicable data processing agreement, which addresses instructions, safeguards, service providers, rights assistance, and return or deletion of data. Contact support to obtain and review the applicable DPA before submitting personal data that requires it.

You warrant that you have the rights and legal grounds needed for your instructions and data processing. We may decline instructions that would violate applicable law or these terms and explain the issue where permitted. The Privacy Policy describes information we process for our own website, account, billing, support, and security purposes separately from customer lead data.

Retention, export, and preservation duties

Evidence retention depends on the subscription and applicable agreement. Choose a period that meets your legal and contractual needs, and arrange any required legal hold under the relevant terms. Do not rely on the service as your only copy where your obligations require an independent archive or a different retention period.

Use available exports while you have access and contact support before the end of a subscription if you need help arranging return of data. After the applicable retention or deletion period, records may be deleted under the agreement and cannot be assumed recoverable. Backup copies remain protected until they expire through the backup cycle.

Deletion and return are subject to applicable legal preservation requirements and the data processing agreement. We may retain account, transaction, or security records where necessary and lawful for our own obligations. Ending a subscription does not require deletion of information that applicable law requires us to preserve.

Service content and third-party requirements

We and the relevant rights holders retain rights in the service software, design, documentation, and other service materials. Your subscription provides a limited right to use the service during the applicable access period under this agreement. It does not transfer ownership of the platform. You may use evidence exports for your lawful business and compliance purposes subject to the rights attached to the underlying data.

Third-party forms, lead vendors, payment services, communications systems, and external evidence providers may have their own terms. You are responsible for the agreements and permissions needed for your integrations. A link or factual comparison does not imply endorsement, a partnership, or compatibility beyond what the service expressly supports.

Availability and warranty limitations

We provide the service with reasonable care, subject to applicable law and any express commitments in your agreement. Maintenance, security work, third-party outages, and circumstances outside our reasonable control can affect availability. An uptime or support commitment applies only where included in the agreement you accept.

To the fullest extent permitted by law, the service is provided as is and as available. We disclaim implied warranties, including merchantability, fitness for a particular purpose, and noninfringement, except where they cannot lawfully be excluded. We do not warrant uninterrupted or error-free operation or that the service prevents claims, satisfies every legal duty, or makes a particular contact lawful.

You remain responsible for reviewing output, configuring integrations, and retaining evidence appropriate to your obligations. Nothing in these terms excludes a warranty or remedy that applicable law makes mandatory.

Limits on liability

To the fullest extent permitted by applicable law, we are not liable for indirect, incidental, special, consequential, or punitive losses, or for lost profits, revenue, business opportunities, goodwill, or data arising from use of the service. This applies regardless of the legal theory of the claim, subject to rights and liabilities that cannot lawfully be limited.

Unless a separately accepted written agreement provides otherwise, our total aggregate liability arising from the affected service is limited, to the extent permitted by law, to the fees you pay for that service for the subscription period in which the event giving rise to the claim occurs. This limit does not apply to fraud, intentional misconduct, or liability that applicable law prohibits us from limiting.

You are responsible for your own marketing, contact decisions, vendor agreements, and legal compliance. These terms do not make us responsible for statutory penalties or claims arising from contacts you make or authorize, except to the extent applicable law or an express written agreement requires otherwise. Mandatory rights take precedence over any conflicting limitation.

Suspension and ending the agreement

We may suspend access where reasonably necessary to address a security risk, unlawful use, a material breach, or an unpaid subscription. We provide notice and an opportunity to resolve the issue where practical and legally permitted. Immediate action may be necessary to protect information, the service, or other people.

Either party may terminate for a material breach that remains unresolved after reasonable notice and an opportunity to cure where appropriate. Termination does not remove accrued payment obligations, lawful preservation duties, or rights that must continue by their nature. Data handling after termination follows the applicable agreement and law. Ordinary cancellation without a separate suspension or termination reason preserves access through the paid period.

Applicable law and disputes

These terms are governed by the law applicable to the administrator of the consentverified.com service and the contractual relationship, subject to mandatory laws and protections that cannot be excluded. Where a separately accepted written agreement specifies governing law or jurisdiction, that provision applies to the extent legally permitted.

Contact [email protected] with a dispute so the parties can try to resolve it. If it remains unresolved, either party may bring it before a court with jurisdiction under applicable law. These terms do not require binding arbitration or waive a mandatory right to bring a claim.

Changes to terms and how to contact us

We may update these terms to reflect changes in the service, commercial terms, or applicable law. The date at the beginning identifies the current version. We provide reasonable notice of material changes through the service or by email before they take effect, except where immediate changes are required by law or necessary for security. Price changes apply prospectively with the notice required by law and the applicable agreement.

Where acceptance of an update is required, we request it. If you do not accept a change, you may cancel before the change affects the next renewal, subject to mandatory rights and any separately agreed terms. No update removes rights that applicable law protects.

Contact the administrator of the consentverified.com service at [email protected] for subscription, contract, or data processing questions. The contact page explains what information helps us review a request.
